The Legal Limit for Atrazine in Your Tap Water Hasn't Moved Since 1992. Three Other Numbers Just Did.

The enforceable legal limit for atrazine in American drinking water is 3 parts per billion, set in 1992, and it hasn't changed in the thirty-four years since. That single fact gets lost in a story that has, in the last two years, actually moved on three separate fronts — just not that one.

Atrazine is a herbicide, used mainly on corn, applied at roughly 70 million pounds a year concentrated in the Corn Belt. Because it dissolves easily in water and resists breaking down, spring runoff carries it into the rivers, streams, and groundwater that supply drinking water to millions of people; it's routinely among the most frequently detected pesticides in U.S. tap water, with levels peaking in late spring and early summer after application.

Here's what's actually changed recently, and it's easy to conflate with the drinking-water number if you're not reading closely. In July 2024, EPA revised a figure called the concentration-equivalent level of concern, or CE-LOC, from 3.4 to 9.7 micrograms per liter. This is an ecological threshold — it governs when watersheds need runoff mitigation to protect aquatic plant communities, not a human health standard, and EPA's own December 2024 Federal Register notice on the revised mitigation proposal keeps that scope explicit. Coverage of this change has repeatedly framed it as EPA "loosening the limit on your water." It isn't; it's a different number, for a different purpose, that doesn't touch the enforceable drinking-water rule.

A second, more recent track: on October 7, 2025, EPA released the U.S. Fish and Wildlife Service's draft biological opinion on atrazine and the related herbicide simazine, under a federal court order requiring a final opinion by March 31, 2026. The draft's own language: the proposed actions "are not likely to jeopardize or adversely modify the majority of species and critical habitats" the agencies evaluated, while flagging a smaller set of species still under review. That's an Endangered Species Act process, a third distinct regulatory lane from both the ecological CE-LOC and the human drinking-water MCL. None of these three lanes has touched the 3 ppb human standard.

A third: in May 2026, an environmental advocacy group filed a formal notice of intent to sue EPA, arguing the agency has gone more than twenty-five years without issuing ambient water-quality criteria for atrazine under the Clean Water Act. That's a notice of intent, not a filed lawsuit and not an EPA action — it signals where legal pressure is building, not what the agency has actually done.

So: three separate 2024-2026 developments, an ecological threshold, an endangered-species opinion, and a threatened lawsuit, and the actual number that determines what's legal in your glass of water is still exactly where it was in 1992.

The European Union took a different path entirely, and did so two decades ago. Under a 2004 European Commission decision, atrazine was not renewed for use in the EU, removing it from the market across member states. The EU's own reasoning centered on groundwater: atrazine kept exceeding the bloc's blanket drinking-water limit, which applies the same threshold, 0.1 micrograms per liter, to any single pesticide regardless of which one it is. That EU limit is thirty times stricter than the U.S. MCL of 3 ppb, but the two systems aren't measuring the same thing with different generosity — the EU applies one precautionary number to every pesticide as a category rule, while the U.S. sets compound-specific limits through a process that weighs toxicological evidence, exposure, and how embedded a chemical is in an existing agricultural system. Different philosophies, different outputs. The EU's stricter number doesn't establish the U.S. number is unsafe; it establishes the two regulatory systems answer a different question.

One caveat on precision: reporting on this topic frequently states that Germany and Italy independently banned atrazine back in 1991, ahead of the EU-wide 2004 decision. We could not trace that specific claim to a primary German or Italian government source, so we're not asserting it as fact here — the EU's 2004 non-renewal is the citable action.

Some U.S. states go further than the federal floor. California sets its own drinking-water limit at 1 ppb, a third of the federal number, and pairs it with a separate, non-enforceable public-health goal set lower still.

This is where atrazine differs usefully from a food additive: you can actually find out what's in your water. Public water systems are required to test for atrazine and publish the results in an annual Consumer Confidence Report, available from your utility, showing whether it was detected and at what level. If you're on a private well, particularly near heavy corn farmland, you're outside that testing requirement and would need to test independently. Where levels matter to you, activated carbon filtration and reverse osmosis both reduce atrazine at the tap.
