Titanium Dioxide Is Banned in the EU. Britain Says That Was a Mistake.

In February 2022, the European Union stopped authorizing titanium dioxide as a food additive. Cross the Channel into the United Kingdom, though, and the same whitening agent is still legal, still reviewed by UK scientists, and still sitting on ingredient labels. Same substance, same underlying evidence file, opposite verdicts — and the gap between them hasn't closed. It's gotten more interesting.

Titanium dioxide (E171 on European labels) is a bright-white pigment used to make food look more opaque and uniform — in candy shells, coffee creamers, frostings, some baked goods. The EU's move to pull it wasn't a snap reaction. It came from the bloc's own food-safety authority. In May 2021, the European Food Safety Authority published a re-evaluation of titanium dioxide and concluded it could no longer vouch for the additive's safety in food. EFSA's expert panel said it could not rule out a concern for genotoxicity — the potential for a substance to damage genetic material inside cells — and because that concern couldn't be excluded, the panel also couldn't establish a safe daily intake level. No safe level meant no basis for continued authorization. The European Commission acted on that opinion with Commission Regulation (EU) 2022/63, formally removing titanium dioxide from the EU's approved additives list, effective February 7, 2022, with a sell-through window for already-labeled products running to August 7, 2022.

The genotoxicity question didn't appear out of nowhere, and it's worth being precise about where it actually came from. In 2010, the International Agency for Research on Cancer classified titanium dioxide as Group 2B — "possibly carcinogenic to humans" — in IARC Monograph Volume 93. That classification was built on studies of rats inhaling airborne titanium dioxide dust in industrial settings, evaluated alongside carbon black and talc specifically because of what happens when poorly soluble particles lodge in the lungs. It was never about eating the stuff. EFSA's 2021 opinion was a separate, food-specific review, driven largely by newer methods for testing nanoscale particles rather than the older inhalation data, and it's the one that actually changed titanium dioxide's legal status as an ingredient.

The United States never adopted EFSA's conclusion, and the divergence doesn't stop at the US-EU line — it runs straight through Europe itself. The FDA still permits titanium dioxide as a color additive under 21 CFR 73.575, capped by regulation at 1% of a food's total weight. In April 2023, a coalition of environmental and consumer-advocacy petitioners — including the Environmental Defense Fund, the Center for Food Safety, the Center for Science in the Public Interest, and the Center for Environmental Health — filed a formal color additive petition asking the FDA to repeal that regulation outright, citing EFSA's findings as grounds. The FDA opened the petition for public comment under Docket No. FDA-2023-C-1487 and, per the agency's own guidance page, is still reviewing it; more than three years after filing, no decision has been announced. Part of the FDA's footing here is a November 2023 assessment from JECFA, the joint FAO/WHO committee that advises on food additive safety internationally: JECFA reaffirmed its long-standing "not specified" intake limit for titanium dioxide, concluding the genotoxicity evidence was inconclusive rather than concerning — while explicitly noting that current test guidelines aren't well suited to nanoparticles and calling for better methods.

Then there's Britain, which split from its own former regulator on this exact file. The UK's Committee on Toxicity reviewed the same EFSA opinion and, in a statement most recently updated in October 2024, reached the opposite conclusion: it set a health-based guidance value of 10 mg per kilogram of body weight per day and found that UK dietary exposure — estimated at roughly 3 to 11 mg/kg bw/day — falls within that limit. Northern Ireland, still bound to EU single-market goods rules under the Windsor Framework, continues to follow the EU ban. Great Britain does not. That means one country, post-Brexit, is currently running two different titanium dioxide policies depending on which side of the Irish Sea a product is sold. "Banned in Europe" was never a single fact to begin with; here, it isn't even a single fact within the UK.

On a US label, look for "titanium dioxide" listed by name, sometimes folded into "artificial color." It shows up most often in candies, creamers, white or pastel frostings, and some coatings. In the UK, the same ingredient is declared as E171. In the EU, you won't find it in food at all anymore — though it's still permitted in medications and select cosmetics there under separate rules that EFSA's opinion didn't touch. A global brand selling in both the US and EU typically runs two formulations of the same product: one reformulated to drop titanium dioxide for the European shelf, one unchanged for the American one. Matching names on a box don't guarantee matching ingredient lists across the Atlantic.
